1. Use of the App
FoilMaster is a digital coaching and training platform for wing foiling and related watersports. The consumer app is for personal, non-commercial use unless we agree otherwise in writing. Users must be at least 13 years old. You are responsible for your own safety when practicing sports shown in the app.
2. Accounts
You are responsible for safeguarding your login credentials. You may sign in with Apple, Google, or email. Sharing login details or circumventing access controls is not permitted.
3. Subscriptions & Billing
Some features require a paid subscription or consumable purchases. Subscriptions renew automatically unless you cancel at least 24 hours before the renewal date in your Apple ID account settings.
- Payments are processed by Apple In-App Purchase.
- Manage, cancel, or request refunds according to Apple's policies and applicable law.
- We may use third-party subscription tooling (e.g. RevenueCat) to manage which features and tiers are available inside the app; your contract for payment remains with Apple.
4. Coaching, Content & User Conduct
FoilMaster may offer remote coaching, messaging, and video review. You retain ownership of content you upload, but you grant us a worldwide, non-exclusive license to host, process, transmit, and display that content to provide the service (including to coaches or schools you interact with).
You agree not to upload unlawful, harassing, hateful, or infringing content. We may remove content or suspend accounts that violate these Terms or create risk for other users. Reports: support@foilmaster.app.
5. Third-Party Services
The app relies on services such as Apple (including Sign in with Apple, In-App Purchase, WeatherKit), Google (e.g. Firebase and optional Google Sign-In), and subscription tooling. Those services have their own terms and privacy notices.
6. Intellectual Property
App content, branding, and software are owned by FoilMaster OÜ or our licensors. You may not copy, modify, distribute, or create derivative works except as allowed by law or with our permission.
7. Disclaimer of Warranties
The app is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not guarantee specific athletic results, coaching outcomes, or uninterrupted service.
8. Limitation of Liability
To the extent permitted by law, FoilMaster OÜ and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the app is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) fifty euros (€50), except where mandatory consumer law says otherwise.
9. Account Deletion
You may delete your account in the app under Profile → Delete Account. If you cannot access the app, contact support@foilmaster.app.
10. Modifications
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance, except where applicable law requires a different process.
11. Governing Law & Consumers
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. If you are a consumer in the European Union or another jurisdiction with mandatory protections, those rights remain unaffected.
